The operator

1. Who we are

1.1

WhoLiesMore.com (“we”, “us”) operates this website and every matchup page on it, together with any other address we publish for the same service. Together they are the Site, and these terms cover all of it.

1.2

Everything goes to [email protected]: questions, complaints, refund requests, data protection requests, corrections under clause 9.4, and legal notices.

1.3

We acknowledge every message within 2 business days and aim to resolve within 30 days. Data protection requests are answered within the period your law sets, normally one month.

Formation

2. Agreement and eligibility

2.1

Using the Site or casting a vote means you accept these terms. If you do not accept them, do not use the Site.

2.2

You must be at least 18, able to enter a contract, and entitled to use the payment method you present. The Site is not directed at children. If we learn a minor has paid for a vote, we refund it and delete the record.

2.3

If you are voting for a company, agency, campaign or other organisation, you confirm you can bind it and it is bound alongside you. Clause 11.5 then applies to you.

2.4

Do not use the Site where doing so would be unlawful where you are, including anywhere that restricts paid voting or the subject of a matchup.

Nature of the service

3. What this is, and what it is not

3.1

The Site is entertainment. Each matchup asks an opinion question and lets anyone pay to add votes to one side of it. The result is a running tally of what paying visitors chose.

3.2

Everything on the Site is opinion. It is not a statement of fact about any person, group, company, product or political party. A matchup question is a provocation, not an allegation.

3.3

It is not a poll, survey or research instrument. Results are self-selected, unweighted, unverified and paid for. They represent no population, use no recognised methodology, and must not be presented, cited or reported as polling, market research or scientific findings.

3.4

It is not a game of chance, lottery, sweepstake, competition or wager. There is no prize and no element of chance, and nothing you buy can win, return or pay out anything. Your payment buys the registration of your vote and nothing else.

3.5

A vote is not an investment, security, share, token, credit or store of value. It carries no ownership, no rights in us, and no ability to redeem, resell or transfer.

3.6

It is not an official vote and has no connection to any election, referendum, ballot or public consultation. It does not affect and does not purport to affect any real-world outcome.

3.7

A vote is not a political contribution, donation or expenditure. No part of what you pay reaches any political party, candidate, campaign, committee, officeholder or ballot measure, and we make no payment to any of them. We are not a political committee and we do not coordinate with any party, campaign or candidate. Nothing on the Site is an electioneering communication, and nothing on the Site offers you anything of value to vote, to register to vote, to abstain, or to vote a particular way in any real election.

The product

4. Votes

4.1

A vote is a one-off digital service. When your payment is authorised we add the votes you paid for to the option you chose in the matchup you chose, and they are reflected in the displayed result. That is the whole of what you buy.

4.2

The contract forms and we perform it at the moment of authorisation. There is no account, no subscription, no recurring charge and no ongoing service.

4.3

One payment can buy one vote or several, up to 999,999. You choose how many before you pay, and each costs the price in clause 6.1. You may buy as many as you like across as many matchups as you like. Doing so is permitted and meaningless: it confers no influence, no standing and no right to any outcome. Clause 8.4 applies once you pass 99 votes.

4.4

Once cast, a vote cannot be changed, moved to another option, transferred, resold, or carried over to another matchup.

4.5

We may close, retire, reset, rename or remove any matchup at any time. That does not entitle you to a refund of votes already cast, and your vote may stop being displayed.

Results and figures

5. How results are displayed

5.1

Results are shown as a percentage split between the available options. We may display or withhold the underlying vote counts at our discretion.

5.2

Displayed percentages are calculated only from votes paid for by visitors to the Site. We do not seed, simulate, pad or otherwise inflate any figure shown on the Site, and no starting figure is included in any result.

5.3

Figures may lag behind real time and may exclude votes still settling with either of our payment processors. They can go down as well as up. A vote is removed and the result recalculated whenever its payment fails, is refunded or is charged back (clause 6.6), or where we remove it under clause 8.2.

5.4

We do not warrant that displayed results are accurate, complete, current or free of error, and we may correct them at any time.

5.5

You are free to screenshot and share Site results. You must not present them as polling, survey or research data (clause 3.3), and you must not use them in a way that suggests we endorse you or your cause.

Money

6. Price and payment

6.1

A vote costs 0.99 in your own currency if you are in the United States (US dollars), Canada (Canadian dollars), the United Kingdom (pounds sterling), Australia (Australian dollars) or a country that uses the euro, and 0.99 US dollars everywhere else. We work out which applies from where your connection comes from, not from anything you enter. The price and currency shown at checkout when you pay are the price payable.

6.2

The price you see is the price we charge. No sales tax, VAT, GST, HST, QST, service charge or processing fee is added at checkout, wherever in the world you are. Where tax is due on your vote in your country, we bear it out of the price and account for it to the tax authority ourselves. It never appears as a separate line and is never passed on to you.

6.3

If you pay in a currency other than the one your card is held in, or with a card issued in another country, your own bank or card issuer may apply a currency conversion or cross-border fee. If you pay in cryptocurrency, the amount you send is set by the conversion rate NOWPayments applies at the time, and the network fee for your transaction is yours to pay. Those charges are between you and the provider that levies them. We do not receive them, control them, or refund them.

6.4

Card and digital wallet payments are processed by Stripe. Cryptocurrency payments are processed by NOWPayments. We never receive or store your full card number, expiry date or security code, and we do not store the crypto wallet address you pay from or any private keys. Stripe passes us a payment reference, the outcome, and limited details such as your full name, email, address, billing country and the last digits of your card. NOWPayments passes us a payment reference, the outcome, and the cryptocurrency used. Each processor's own terms and privacy notice also apply to your use of checkout, and each processes some of your data as an independent controller for its own fraud prevention and legal compliance purposes.

6.5

You confirm you are entitled to use the payment method you present. Using a payment method that is not yours is fraud and we will report it.

6.6

A vote only counts while its payment stands. If a payment is declined, fails, does not settle, is cancelled, reversed, refunded or charged back, the vote is void and is removed from the tally, and the displayed result is recalculated without it. This applies however long afterwards, and whether the reversal comes from you, your bank or wallet provider, either processor, or us.

6.7

We may change prices at any time. A price change never applies to a vote already paid for.

6.8

Cryptocurrency payments that arrive short or long. The amount of cryptocurrency that reaches us can differ from the amount quoted at checkout, because exchange rates move between the moment you are quoted and the moment your transaction confirms, and because some wallets and exchanges deduct network fees from the amount sent rather than adding them on top. We do not void a payment for this. We credit the votes your payment actually covers: we compare the cryptocurrency that reaches us with the amount we quoted, apply that proportion to the price of the votes you selected, and round down to the nearest whole vote. Our payment processor's own fee is ours to bear and never reduces the votes you receive. If you send more than quoted, you receive whatever additional whole votes the surplus covers. Any remainder too small to buy a whole vote is retained and is not refunded. Both the number of votes you selected and the number credited are recorded, and appear on your receipt where you asked for one.

Consumer rights

7. Refunds and withdrawal

7.1

A vote is a digital service performed the instant your payment is authorised, so votes are non-refundable except as set out in this section or as the law where you live requires.

7.2

We always refund a payment taken in error, taken twice for the same vote, taken where the vote was never registered, or taken from someone under 18. Clause 7.7 governs how a cryptocurrency refund is made.

7.3

EU / EEA / UK. Consumers normally have 14 days to withdraw from a distance contract without giving a reason. That right is lost for a digital service once performance has begun with your prior express consent and your acknowledgement that you lose it. At checkout you are asked to confirm both before you pay, and we record that confirmation and repeat it on your receipt. The agent checkout in clause 8.7 does not ask for it, and clause 8.7 explains what that means for you. If you would rather keep your 14-day right, email us before paying and we will register your vote at the end of the withdrawal period instead. A model withdrawal form is available from us on request at [email protected].

7.4

Canada. Nothing in this section limits your rights under the consumer protection legislation of your province or territory, including any right to cancel a distance agreement and be refunded where required information was not disclosed to you before you paid.

7.5

US. Nothing in this section limits any non-waivable right you have under the consumer protection law of your state.

7.6

To request a refund, email us with the payment reference from your receipt. Approved refunds go back to the original payment method, normally within 10 business days. Refunded votes are removed from the tally. Clause 7.7 governs cryptocurrency refunds.

7.7

Cryptocurrency refunds. A cryptocurrency refund is returned only to the exact address the payment came from. NOWPayments holds that address and sends any refund straight to it, so we still neither receive nor store it and clauses 6.4 and 12.2 are unchanged. We will not ask you for a refund address, and we will not send a cryptocurrency refund to any address other than the originating one. Where NOWPayments cannot return the funds to the originating address, no cryptocurrency refund is possible and none will be made. Checkout tells you this before you pay. Where a refund is possible we return the quantity of cryptocurrency you sent, less 10% of that quantity which we retain for processing and network fees, rather than its US dollar value. Movements in the exchange rate between your payment and your refund do not change the amount returned. Where we refund you under clause 7.2 or 7.3, or because we removed your vote under clause 8.2, we return the full quantity and take no deduction.

Conduct and integrity

8. Fair use and vote integrity

8.1

You must not:

  • use bots, scripts, emulators or any automated means to cast votes or access the Site, except as clauses 8.6 and 8.7 allow or, for reading public pages, as our robots.txt file permits;
  • use payment methods or identities that are not yours, or buy access to them;
  • circumvent rate limits, fraud controls or any other technical measure;
  • scrape, mirror or systematically extract Site data;
  • probe or test the Site's security, or interfere with its operation;
  • use the Site to harass, defame or target any individual;
  • use the Site unlawfully, or in breach of sanctions or export control law.
8.2

We may block, rate-limit or refuse service to any visitor, payment method or network we reasonably believe is doing any of that, without notice, and we may remove votes cast that way before or after they appear in a result.

8.3

A vote removed under 8.2 is refunded. Where it was paid for with a payment method that was not yours, we return the payment to the person it belongs to instead.

8.4

High-volume voting. There is no cap on how many votes you may buy. Once more than 99 votes have been paid for by the same person or payment method, whether in one matchup or several and whether at once or over time, we keep more information about those payments than we otherwise would: the card or digital wallet identifiers our processors expose to us, which never include the crypto wallet address you pay from, and the IP address, device information and timestamp of each vote held against the payment record rather than in our general logs. On political matchups clause 12.4 applies to these records as well, however many votes you buy. We use these records only to confirm the payment method is genuinely yours and to defend chargebacks. We keep them while the dispute window for those payments stays open, up to 24 months, then delete them. Section 12 applies to them in full.

8.5

If you have a problem with a charge, email us before going to your bank. We can usually refund faster than a chargeback resolves, and it costs you nothing. A cryptocurrency payment cannot be charged back at all, so emailing us is the only way to put one right.

8.6

AI agents acting for you. You may have an AI agent or assistant help you vote, but only through the same checkout and the same security checks every visitor uses, or through the agent checkout in clause 8.7. When you do: (a) you are the buyer, these terms bind you, and you must meet clause 2.2, so you are at least 18, able to enter a contract, and entitled to the payment method or wallet the agent uses; (b) the agent may spend only your money, only with your authority, and only on your own votes, and it may not vote for anyone else or pool money from several people; (c) whatever the agent does on the Site counts as done by you, including accepting these terms; (d) the agent must not get round, outsource or solve for others any security check, rate limit or fraud control, and the rest of clause 8.1 applies to it in full; (e) if the agent acts for a company, clause 2.3 applies. Our posts are addressed to people, and our agent checkout page explains how that checkout works. Nothing we publish is an instruction to an AI agent to pay us, and an invitation to vote never authorises an agent to spend anyone's money. If an agent spent your money on votes without your authority, email us with the payment reference and we will remove those votes under clause 8.2 and refund them under clause 8.3, returning cryptocurrency as clause 7.7 allows. We do not show whether a vote was cast with an agent's help, and we record it only for a payment started through the agent checkout in clause 8.7.

8.7

The agent checkout. An AI agent may also buy votes for you in cryptocurrency through our agent checkout, which has no browser security check and is described at wholiesmore.com/agents/. It is open only on the matchups that page lists, takes from 1 to 25 votes a payment, and takes only a limited number of payments across all agents in any hour or day, so it may refuse a request. Clause 8.6 (a) to (e) applies to every vote bought this way, and the agent must confirm in each request that you are at least 18 and have told it to buy those votes. The price is set under clause 6.1 by where the agent's connection comes from, and only a confirmed payment counts. The agent must send the exact amount shown with the network fee on top; clause 6.8 applies to a payment that arrives short or long. We may refuse connections from some places, and we may close the agent checkout at any time; votes already confirmed still count. The agent checkout does not ask for the confirmation described in clause 7.3, so if you are a consumer in the EU, EEA or UK you keep your 14-day right to withdraw from a payment made through it: email us within 14 days of paying and we will remove those votes and refund the full amount as clause 7.7 allows.

Third parties

9. Named parties and trademarks

9.1

Some matchups name real companies, products, groups, institutions or political parties. Those names are used solely to identify the subject of an opinion question. That is referential use and not a claim of any commercial relationship.

9.2

We are not affiliated with, sponsored by, endorsed by or in partnership with any party named in a matchup. All trademarks, trade names and logos belong to their respective owners.

9.3

A matchup question, its title and its results are expressions of opinion by us and by voters. They are not assertions of verifiable fact about any named party, and no reasonable reader should take them as findings that a named party has behaved dishonestly, unlawfully or improperly.

9.4

If you are a named party and you believe a matchup misrepresents you, email us with the specific wording at issue and why. We will review promptly and will amend, clarify or remove where warranted. This is not an admission of liability and does not limit any right either of us has.

9.5

Nothing on the Site is advertising for any product or service of ours, or comparative advertising about any named party.

Ownership

10. Our content and yours

10.1

The Site, its name, design, code, copy, graphics and charts are owned by or licensed to us. You get a personal, non-exclusive, non-transferable, revocable licence to view the Site and cast votes, and nothing else.

10.2

If you send us a matchup suggestion or feedback, you grant us a worldwide, royalty-free licence to use, adapt and publish it in connection with the Site, with no obligation to use it, credit you or pay you. This licence covers suggestions and feedback only. It does not cover your complaints, refund requests, data protection requests or legal notices.

10.3

Do not send us anything confidential, anything you do not own, or anyone else's personal information. We may decline to publish any submission.

Risk

11. Disclaimers and liability

11.1

Subject to 11.3 and 11.4, the Site and every vote are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise the Site will be available, uninterrupted or error free, and we may suspend, withdraw or change any part of it at any time.

11.2

Subject to 11.3 and 11.4, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, business interruption or reputational harm. Our total aggregate liability arising out of or relating to the Site and these terms is limited to the greater of what you paid us in the 12 months before the claim arose and $99 USD.

11.3

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that cannot be excluded or limited by law.

11.4

Consumers. If you are a consumer, 11.1 and 11.2 apply only to the extent your law allows. Your statutory rights, including in the EU, EEA, UK and Canada and in US states that do not permit these exclusions, are unaffected. Where your law requires it, our liability for foreseeable loss caused by our breach or negligence is not capped.

11.5

Business users. This clause applies only if you use the Site for business, professional, campaign or organisational purposes, and never to consumers. You will indemnify us against claims, losses, liabilities and reasonable legal costs arising from your breach of these terms, your misuse of the Site, or your breach of law.

Data

12. Privacy notice

12.1

This section is our privacy notice and forms part of these terms. The controller of your personal data is the operator named in clause 1.1. You can reach us at [email protected].

12.2

We collect as little as we can. To sell you a vote we collect your full name, email address and billing address, a payment reference, your billing country and the country your card was issued in from our payment processors (clause 6.4), and the option you chose, including on political matchups, where clause 12.4 explains how that choice is protected. Where you pay in cryptocurrency we receive less than this: a payment reference, the outcome and the cryptocurrency used, and we do not store the wallet address you paid from. We also record the country and region your connection comes from and, for a payment started through the agent checkout in clause 8.7, that it came through that checkout. The agent checkout collects no name, email or address. Our servers log IP address, browser and device information, and the time of each request. We never ask for your date of birth, and we never see your full card number or your wallet keys. Clause 8.4 covers the additional data we keep for high-volume voting.

12.3

We use that data to take payment and issue receipts, to register and display your vote, to attribute votes to countries in aggregate, to prevent the conduct described in section 8, to answer you when you contact us, to meet our tax and accounting obligations, and to keep the Site secure. Where a legal basis is required we rely on performance of our contract with you, our legitimate interest in running the Site securely and honestly, our legal obligations, your consent where we ask for it, and your explicit consent, given at checkout, for the political matchups described in clause 12.4.

12.4

Political matchups. On any matchup concerning political parties, political groups or political opinion, we record which option you chose against your payment, as we do on every other matchup. We keep it for one purpose only: so that a refund, chargeback or other reversal can be taken off the side it was counted for, and the displayed result stays accurate (clause 6.6). Because your choice can reveal your political opinion, which the law in many places, including the UK and the EU, treats as a special category of personal data, we process it only with your explicit consent, which you give at checkout before you pay. We never pass it to our payment processors, which are told only that you bought votes on that matchup, not for which side. We keep it in our own records, which the database, hosting and spreadsheet providers described in clause 12.6 store for us. They hold it only on our behalf and on our instructions, under a duty of confidentiality, and may not use it for any purpose of their own. We never sell or publish it, never use it for anything else, and never combine it with other data to profile you. Only the people who run the Site can see it, and only to handle a refund, a dispute or a request from you. We disclose it to anyone else only where the law compels us to. Once your payment can no longer be refunded or disputed, and in any case no later than 24 months after you paid, we delete the link between your payment and your choice: your vote stays counted, but nothing then records whose it was. You can withdraw your consent at any time by emailing us, and we will delete the link then, although a payment reversed after that can no longer be taken off the right side.

12.5

What we do not do. We do not sell your personal data or share it for cross-context behavioural advertising. We build no advertising profiles and run no third-party advertising trackers. There is no account, no password and no login.

12.6

We share personal data only with the suppliers who make the Site work: our payment processors (clause 6.4), our hosting, database and infrastructure providers, the spreadsheet service we keep our payment records in, and our email provider. They act on our instructions, except that our payment processors also act as independent controllers for their own fraud prevention and legal compliance purposes. We also disclose data where the law requires it, in response to a valid legal request, and where necessary to establish, exercise or defend a legal claim. If our business is sold or merged, data may transfer with it and this notice continues to apply.

12.7

We keep payment and receipt records for as long as tax and accounting law requires, normally seven years. On political matchups the link between a payment and the option chosen is deleted sooner, as clause 12.4 describes. We keep technical logs for no more than 12 months, unless we need them for an open fraud or security investigation or clause 8.4 applies. Vote tallies are aggregate figures and are not personal data, so they remain on the Site after an individual record is deleted.

12.8

We and our suppliers operate in more than one country, so your data may be processed outside the country where you live. Where we transfer personal data out of the UK, the EEA, or anywhere else that restricts transfers, we rely on the safeguards the law allows, including standard contractual clauses. Ask us and we will tell you which apply.

12.9

Depending on where you live, you may have rights to access, correct, delete, port or object to the processing of your personal data, to withdraw a consent you have given, and to complain to your data protection authority. In the EU that is the authority in the country where you live or work; in the UK it is the Information Commissioner's Office; in Canada it is the Office of the Privacy Commissioner or your provincial equivalent. To exercise any right, email us with the payment reference from your receipt so we can find the right record and confirm it is yours. We answer within the time your law allows, normally one month.

12.10

We use only the cookies and similar technologies needed to make the Site work and keep it secure. We also measure how the Site is used, without cookies and without identifying anyone: page views, clicks on the Site's buttons, how far pages are read, and which website or shared link a visitor arrived from, kept only as totals and never with the side anyone chose. Two services help, and neither sets cookies or is told who you are: Cloudflare Web Analytics counts visits and how fast pages load, and Microsoft Clarity shows how pages are used, as heatmaps and recordings of single page views (pointer movement, clicks and scrolling, with all text and anything you type hidden). A recording can show which button someone pressed, so Clarity is not used on the Republicans or Democrats page, where that would reveal a political view. Microsoft processes Clarity data under its own privacy terms. Where we use anything beyond that we ask your consent first, and refusing does not stop you voting.

12.11

We take reasonable technical and organisational measures to protect personal data, including encryption in transit. No system is completely secure. If a breach affects you and the law requires us to tell you, we will.

12.12

The Site is not for anyone under 18 and we do not knowingly collect their data. If you believe a child has given us personal data, email us and we will delete it.

Disputes

13. Governing law and disputes

13.1

Email us first. Most disputes over a 99 cent payment resolve in one message.

13.2

Governing law. These terms, and any dispute arising out of them or out of your use of the Site, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict of laws rules. This applies wherever you live, including the United States, the European Union, the EEA and the United Kingdom.

13.3

Courts. If a dispute cannot be resolved between us, it will be dealt with in the courts of the Province of Ontario, Canada, and you and we submit to the exclusive jurisdiction of those courts. This applies wherever you live.

13.4

You and we waive the right to bring or take part in any class, collective or representative action, and, where that right would otherwise exist, the right to have a claim heard by a jury. Every claim is brought individually.

13.5

Your mandatory rights. Nothing in 13.2, 13.3 or 13.4 deprives you of the protection of any consumer law of the country, province, state or territory where you live that cannot be excluded by agreement, or of any right that law gives you to bring proceedings where you live. Where that is so, those rights prevail and the rest of this section still stands.

13.6

Either of us may bring an individual claim in a small claims court that has jurisdiction, and either of us may apply to any court for an injunction to protect intellectual property or to stop misuse of the Site.

13.7

Any claim must be brought within one year of the event giving rise to it, except where the law that applies to you requires a longer period.

Boilerplate

14. General

14.1

Changes. We may update these terms. The version in force when you cast a vote governs that vote. If a change materially reduces your rights we will say so clearly on the Site before it takes effect. Prior versions are available on request.

14.2

Suspension. We may block your access, refuse your payments and remove your votes if you breach these terms, if the law requires it, or if we reasonably believe your use puts the Site, other visitors or us at risk.

14.3

Survival. Sections 3, 5.5, 8, 9, 10, 11, 12 and 13 survive any termination or suspension.

14.4

Severability and waiver. If a provision is held unenforceable it is narrowed to the minimum extent needed, or severed, and the rest stands. If we do not enforce a right, we have not waived it.

14.5

Assignment. You may not assign these terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.

14.6

Entire agreement. These terms and anything shown at checkout are the whole agreement between us about the Site. Nothing here excludes liability for fraudulent misrepresentation.

14.7

No third-party rights, force majeure, language. No one other than you and us may enforce these terms. We are not liable for failure or delay caused by events beyond our reasonable control. These terms are drafted in English; any translation is for convenience and the English version governs unless your local law requires otherwise.

Thank you for paying to be counted. Most people never will, which is exactly why your vote carries weight their opinions never can.
